General Terms and Condi­tions (GTCs)


SCOPE
 

These General Terms and Condi­tions (GTCs) shall apply to all guest accom­mo­dation contracts concluded between OSWALD Facility-Management GmbH (sevenDays Heidelberg) with third parties (Guest), as well as to all other services and deliveries provided by sevenDays Heidelberg. 



RESERVATIONS/ RESALE 

An accom­mo­dation contract has been concluded when a booking is submitted via the website of sevenDays Heidelberg or by the written confir­mation of a booking by the guest. This agreement, in the form of a reser­vation of ordered rooms, shall be binding on both parties (according to the corre­sponding booking rate and its possi­bility of cancel­lation). No entit­lement to use the accom­mo­dation service in a specific room shall exist. sevenDays Heidelberg reserves the right to rent the reserved rooms otherwise after the reser­vation has expired or the payment period has elapsed (in the case of advance payments). The guest shall receive a binding booking or reser­vation number from sevenDays Heidelberg, and on express request also a written reser­vation confir­mation (by email). 

sevenDays Heidelberg reserves the right to define industry-standard restric­tions such as minimum stays, booking guarantees or deposit payments for certain dates. 

The resale/rental and/or rebro­kerage of booked apart­ments is prohi­bited. In parti­cular, the subletting of apart­ments and/or room contin­gents to third parties at higher prices than the actual apartment rental prices shall not be permitted. In such cases, OSWALD Facility-Management GmbH shall be entitled to cancel the booking, parti­cu­larly if the guest has provided incorrect infor­mation regarding the type of booking or the payment to the third party at the time of assignment/sale. Use of the apartment for any purpose other than accom­mo­dation is not permitted. 

 

GUARANTEED RESERVATIONS, CANCELLATION PERIODS 

Bookings can generally be changed up to 15 days before the arrival date via the desired booking portal. Should you have any queries, please use the chosen portal. If you have booked directly (telephone/email), please contact us. 

 

CANCELLATION POLICIES 

Bookings made at the standard rate can be cancelled free of charge up to 14 days before the arrival date. Early booker rates do not include a cancel­lation option. Guests are advised to check the cancel­lation policy in advance for direct bookings and/or if they are unclear about their own booking. Bookings made on the same day as arrival cannot be cancelled free of charge. 

 

ADVANCE PAYMENTS OF THE ACCOMMODATION PRICE 

The credit card shall be checked and shall serve as the security for your booking. sevenDays reserves the right to charge the guest’s credit card in accordance with the cancel­lation option and the rate policy of the booking portals. If the guest of sevenDays Heidelberg does not mention about another payment method, it shall be assumed that a credit card payment is desired. 

 

TAXES/ FEES/ DUTIES 

The appli­cable rates are gross total prices; they include all statutory taxes, fees and charges. In the event of a change in taxes, fees and duty rates (levies), as well as the effective imposition of new taxes, fees and charges previously unknown to the parties, OSWALD Facility-Management GmbH reserves the right to adjust the prices accor­dingly. 

 

MEANS OF PAYMENT / SERVICES ON INVOICES TO BE PAID LATER 

Valid means of payment are cash in euros, EC card, Master Card, Visa Card and American Express in euros. The provision of services on invoices to be paid later shall 54not be subject to the payment agreement of sevenDays Heidelberg. 

 

USE OF RESERVED APARTMENTS 

Reserved apart­ments shall be available to the guest from 3:00 pm on the day of arrival, and until 11:00 am on the day of departure. 

 

LIABILITY OF THE GUEST; LUMP-SUM COMPENSATION CLAIMS ON THE PART OF THE HOTEL DUE TO THE LOSS OF THE HOTEL ROOM KEY 

Guests are liable to the hotel for any damage caused by them. Self-inflicted damage to rooms, furnis­hings and other premises of the hotel must be reported by the guest to the hotel immediately. Any other damage or malfunc­tions must also be brought to the attention of the hotel straigh­taway. If the hotel has a credit card for guarantee purposes, the hotel shall be entitled to charge it immediately in the event of any damage incurred. The guest may reserve the right to prove a lesser damage.  

A lump sum of € 50.00 shall be charged for the loss or damage of the key posted to the guest. The overnight stay of non-regis­tered guests at sevenDays Heidelberg is not allowed. For each case of violation, the regis­tered guest shall be obliged to pay sevenDays Heidelberg damages to the amount of the corre­sponding usual costs for any additional occupancy of the apartment. The holding of celebra­tions of any form at sevenDays Heidelberg is strictly prohi­bited. For each case of infrin­gement, the regis­tered guests will have to pay a lump-sum compen­sation of €2,000 to sevenDays Heidelberg. 

 

LIABILITY OF SEVENDAYS HEIDELBERG 

OSWALD Facility-Management GmbH shall be liable for any damages resulting from injury to life, body or health for which it is respon­sible. Furthermore, sevenDays Heidelberg shall be liable for other damages that result from an inten­tional or grossly negligent breach of duty. Further claims for damages are excluded, unless otherwise stipu­lated in these GTCs. 

Should any distur­bances or defici­encies occur in the services of sevenDays Heidelberg, sevenDays Heidelberg shall endeavor to remedy the situation on becoming aware of them or should the guest immediately complain about them. The guest shall be obligated to contribute what is reasonable for them to remedy the disrup­tions and to keep any possible damage to a minimum.
